Village Response to Justin Gravatt's Presentation

The Bald Head Association (BHA) Board of Directors has received an application by the Village of Bald Head Island (Village) for approval of a new ADA-approved (American Disabilities Act) beach access. The application has been approved by BHA’s Architectural Review Committee (ARC) for approval of the proposed structure. It is required next for the BHA Board to decide whether or not to approve the application. Specifically, the Board is required under the covenants to review and approve any construction that impacts the dunes, the common area and/or the parking. Each of these is implicated by this application and, therefore, require BHA Board approval.
 
The Village is proposing to build this new beach access on Lot 1319 on South Bald Head Wynd, which is approximately opposite Black Skimmer Trail. The covenants now require us to follow a two- or three-step process to consider and act on the application.
 
Step One — An Informational Meeting for all on April 18, 2022, at 2:00pm

Prior to the Board voting on whether or not to approve this project, the Board wants to hear from the Village, the BHA membership and anyone else. This may include anyone whom members or the Village want to present to give their thoughts and opinions regarding whether or not the BHA Board should approve this application. Accordingly, an Informational Meeting will be held on April 18, 2022, at 2:00pm. The meeting will begin at the site of the proposed access — 327 South Bald Head Wynd, Bald Head Island. At that time the Village will explain to all present the proposed project and will answer any and all questions anyone has. Further, anyone else who desires to speak regarding the proposed project at this time will be afforded the opportunity to do so.
 
Thereafter, the meeting will move to BHA’s Association Center (111 Lighthouse Wynd) and will continue in person and virtually via Zoom (click HERE for the Zoom link). The Village will then be able to complete its presentation and answer any additional questions anyone has. At that time any member of the public will be able to speak and present any and all information they have relating to the proposed project. All are welcome to speak, and the Board looks forward to hearing from them. Thereafter, the informational meeting will be adjourned.
 
Step Two — The Board of Directors will meet on April 22, 2022, at 10:00am

The Board of Directors will meet at BHA’s Association Center on April 22, 2022, at 10:00am to decide whether or not to approve the application by the Village. This meeting will be a public meeting, and all are invited to attend in person or by Zoom (click HERE for the meeting link). Between April 18, 2022, and April 22, 2022, any and all are encouraged to submit to the Board any facts, opinions or other information they would like the Board to consider in deciding whether or not to approve this application. All submissions should be emailed to Carol Collins, BHA’s Interim Executive Director, at carolc@baldheadassociation.com. In addition, any person who desires to speak in favor of, in opposition to or just relating to whether or not the Board should approve the application by the Village will be given the time to speak.
 
The Board will then vote and decide whether or not to approve the application. If the Board denies the application, that will terminate the application. If the Board approves the application, the application will be submitted to the members for approval.
 
Step Three — If approval by the Board takes place, a Special Meeting of the membership for approval will be held on June 7, 2022, at 10:00am
UPDATE (4/22/2022 11:25am) — Due to the vote of non-approval at the 4/22/2022 Board meeting, a Special Meeting of the membership is no longer necessary.

Approval by the BHA membership is required because lot 1319, owned by the Village and where the access will be made, is like all residential lots on BHI and subject to a single-family residential limitation. In order to remove that limitation, the members must approve an amendment of the covenants for this lot. That meeting will be held on June 7, 2022, at 10:00am at BHA’s Association Center and virtually via Zoom webinar (click HERE to register; after registering, you will receive a confirmation email containing information about joining the webinar). The information for the meeting will be mailed to all members at least 30 days in advance of the meeting. If the members vote to approve the change in the covenants, the application will then be approved and can proceed forward. If the members do not approve the change, the application will be denied.
